By purchasing product(s) and/or services and receiving information from Firefly Dance Club you express your understanding of, and agreement with, the terms and conditions contained herein. Privacy Statement/Consumer Data Policy

This privacy statement also applies to visitors to our website who have agreed to receive e-mail marketing from Firefly Dance Club and/or its subsidiaries. Any personal profile information you submit to Firefly Dance Club remains your property, and by submitting that information to Firefly Dance Club, you grant Firefly Dance Club, the right to use that information for marketing purposes.

Firefly Dance Club will not sell, rent, swap or give your personal information to any third parties without permission. When a person orders a product directly or via our website you agree and acknowledge that your details can be passed on to the relevant supplier for the purposes of order fulfillment and delivery. Firefly Dance Club is not responsible for any actions taken by these suppliers and their privacy statements need to be consulted. Firefly Dance Club may also use such information to fulfill orders, track shipments and/or for content improvement and feedback purposes.

If you do not want to receive e-mail from us in the future, please unsubscribe yourself through the link provided on the bottom of each email sent to you by us.

If you purchase products or services from Firefly Dance Club via credit or EFTPOS cards, we reserve the right to relay your credit card or bank details through a trusted secure third party payment gateway to ensure a smooth transaction. Any information will be kept securely. Credit/debit card details given to Firefly Dance Club for purchases over the phone will be shredded once the transaction has taken place.

Access to all our customers’ information is restricted to personnel who need it to perform specific authorised functions. These personnel are all subject to Firefly Dance Club’s Privacy Policy. Received information is treated very seriously to assure your privacy both on and off-line.

Specific Terms & Conditions

Fitness to Use Firefly Dance Club’s Services

Firefly Dance Club strongly recommends that you take expert medical advice prior to commencing any excercise program if you are in any doubt about your ability to safely engage in physical activity, which can sometimes be strenuous. Whilst every effort is made to avoid any injury, Firefly Dance club shall not be liable for any death, personal injury or illness occurring upon club premises or as a result of the use of facilities.

You will be required to sign a Welcome to Firefly Dance Club form on your first visit in which you state that each time you use club premises you know of no medical or other reason that physical activity would be detrimental to your health, safety, comfort or physical condition.

Age Range at Firefly Dance Club

Firefly Dance Club caters for adults of all ages from 16 to late in life. However, for 16 – 18 year olds, we will ask for parental permission or attendance with the young person as they could be partner dancing with those considerable older.

Being on time

Classes run for 45 minutes and the next class starts immediately afterwards. It is your responsibility to be on time as if you are late, the lesson will still finish at the scheduled time so as not to inconvenience the next customer, or interfere with the smooth running of the Studio.  For a group class, it is at the discretion of the teacher or Management to decide if it is appropriate for you to join in a class if it has been running for 10 minutes or more.

Exclusion from Firefly Dance Club

Customers must follow the directions of Firefly Dance Club personel at all times and abide by the protocols and etiquette of social partner dancing. Firefly Dance Club reserves the right to exclude individuals, either temporally or permanently, whose behaviour represents a threat, or amounts to harrassment of others, or could bring the Firefly Dance Club into disrepute, or are drunk and disorderly, or for any other reason deemed serious by Management.

Photography at Firefly Dance Club

On the Welcome to Firefly Dance Club form, signed on your first visit, you consent that photographs taken of you, while on Firefly Dance club premises or at Firefly Dance Club events can be used on Firefly Dance Club marketing materials, including the website. If you opt out we will not use individual or small group photographs of you but may use photographs of larger groups in which it would be difficult to identify individuals.

Photographs taken by other than Firefly Dance Club personnel may only be taken for personal use and may not be published other than on the Firefly Dance Club website without the permission of the Firefly Dance Club. No commercial photographers can take photographs or videos without express written permission for the use thereof.

Wherever possible, Firefly Dance Club will seek the express agreement of the individual’s concerned before their images are used in marketing materials. including on the website.

Mobile Phones in the Studio

All mobile phones are to be turned off while you are in a class or lesson, as answering calls is most disruptive both for you and others.

Viewing classes

Firefly Dance Club occassionally allows people to watch classes. However, they must be cognisant of the safety, security and ease of our students and teachers.  Interuptions or distractions to classes or other students is not allowed.

Lost Property

Students should take all their property into the studio with them. Please remember to take everything with you after classe as the Firefly Dance Club cannot take responsibility for anything left behind in the Studio.

Teachers

Occasionally, teachers are unavailable at short notice for private lessons. Every endeavor is made to call affected students to gain their agreement to having their lesson with a suitable substitute teacher.  Alternatively, they are free to reschedule without charge.

If a group class is affected, Firefly reserves the right to allocate another teacher with appropriate experience. As all teachers follow the same sequence in our group classes, students will not be disadvantaged.

Where only one person shows up to a casual class

In this case a 30 minute private lesson will be given.

What constitutes a Private Lesson as distinct from a Custom Group

A private lesson (and private lesson fees) apply to one person or two people sharing a private lesson.  Three or more people sharing a lesson that is not a group class timetabled by Firefly Dance Club, is a Custom Group and separate charges apply.

Timetable & Fees

The timetable is subject to change each month.

Advance warning of 30 days of any change in pricing will be advertised in the Studio and apply to existing students. Price rises will be posted on the website and apply to new students from the posted date.

Cancellation Policy

Firefly Dance Club requires a minimum of 24 hours notice when cancelling or postponing a private lesson.  Late notification will result in the lesson being charged, unless it is the first occasion or if Firefly Management agrees to waive the charge.  If you can reschedule within that week (Monday to Saturday) or if Firefly can resell the timeslot, you will not be charged.

If you wish to transfer a group class enrollment, changes must be made a minimum of one week before the first class.

Private, group classes and Social Events, once paid, are not refundable. It is Firefly Dance Club’s policy that you pay at least one lesson in advance, if you are taking private lessons.  It is your responsibility to check future bookings before leaving the Studio and to diarise bookings. Firefly Dance Club does not routinely make courtesy reminder calls.

Studio Hire

By hiring the Firefly Dance Studio studio, you automatically and voluntarily agree to the following conditions, unless we specifically agree to vary them:

You are responsible for all damages to the room and all equipment herein.

You are  fully responsibe for ensuring that the studio is returned in the same condition as it was hired.

You agree to assume full responsibility for any risks, injuries or damages, known or unknown, which are incurred within the Firefly Dance Studio, as a result of your use.

You agree to waive any claims against Firefly Dance Club or any of its employees for injury or damages, for any reason, including negligence and other acts.

Firefly reserves the right to cancel your reservation with 24 hours notice and without reason. Full refund will be given. If you cancel a studio reservation less than 24 hours before the hired time, Firefly Dance Club requires a full payment.

You are required to have, and provide a current copy to Firefly Dance Club, Public Liability insurance of minimum $10m.

Spam

Firefly Dance Club does not participate in spamming and maintains a zero tolerance spam policy. Those who enter into business relationships with Firefly Dance Club (including, but not limited to, affiliates and joint venture partners) and choose to promote Firefly Dance Club using spam will have their relationship with Firefly Dance Club terminated immediately.

Unauthorized Opt-In

In order to protect our opt-in e-mail list, we are currently in the process of implementing a system by which we will record the IP addresses of all sales and affiliates. If an e-mail address is subscribed to our system without the owner’s permission, the host of the IP will be contacted and pursued to terminate the user.

Fraud

Firefly Dance Club will pursue and prosecute to the fullest extent of the law any individual(s) who attempt to use our systems or software for the purpose of fraudulent transactions.

Firefly Dance Club respects the request of any individual asking to have his/her e-mail address opted-out of our database. As well, every e-mail sent by the Firefly Dance Club provides an automated unsubscribe option at the bottom of each e-mail.

Any quotes, statistics and information used on this website are based on third party research. Firefly Dance Club has taken all possible steps to determine the accuracy and validity of these materials and information and can give no absolute assurances in relation to them.

Customers wishing to make a claim on any warranty or guarantee provided by Firefly Dance Club and/or any of its suppliers will be required to provide documentary evidence in support of their claim. This documentary evidence will need to be sent to Firefly Dance Club to enable the claim to be processed. All claims must be lodged within 30 days of the date of purchase from Firefly Dance Club, unless otherwise expressly stated in the specific warranty or guarantee as supplied with the particular service or product purchased. Firefly Dance Club reserves the right to vary the terms of it’s warranties or guarantees at any time.

We make every effort to ensure that we accurately represent these products and/or services and their potential in various applications. We cannot guarantee your future results and/or success from any of our dance classes, products or services. The use of our products and/or services should be based on your own due diligence and you agree that our company is not liable for any success or failure in the performance of the particular product or service for your specific application. How you progress in terms of your dance ability will be determined by your level of application and time directed to your own private practice following you lessons at Firefly Dance Club.

Firefly Dance Club may at any time revise these Terms and Conditions of Use by updating this posting. By using this site, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms and Conditions of Use to which you are bound.

Transaction Currency

All prices quoted on this site are in Australian Dollars (AUD). All orders processed will also be in Australian Dollars (AUD).

Refunds and Return

If you feel that Firefly Dance Club has not provided it’s products or services to your expectation please advise immediately. If a product arrives damaged in any way, please report the damage to Firefly Dance Club immediately following receipt of order. Depending on the damage sustained to the product Firefly Dance Club shall at it’s discretion repair or replace the order, or provide any other solutions it deems as appropriate.
